What is the Golden Visa or the Spanish residency through property purchase?
The Golden Visa programme is a special type of residence, aimed at all those citizens from outside the European Union who wish to move to Spain and who intend to make an investment in Spain as a means of obtaining it. The Golden Visa is, in essence, a residence permit in Spain to attract non-EU foreign investors and entrepreneurs.
How does the Golden Visa work?
The Golden Visa does not automatically grant a work permit, nor does it imply that the foreigner in question must necessarily reside in Spain. In fact, it is enough to enter the Spanish State once a year. The visa and residence permit are valid for the applicant, the spouse, minor children and also dependent family members.
It targets mainly Russians and Chinese, but also Hindus, citizens of the monarchies located in the Persian Gulf and Americans, who show great interest in obtaining residence in Europe, especially in Spain.
Beyond access to the national market, the Golden Visa has the added attraction of allowing free movement within the Schengen area for up to three months within a six-month period. Austria, Belgium, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Slovakia, Slovenia, Spain, Sweden, Switzerland.
Countries that are in the EU but not adhered to the Schengen Agreement are excluded: United Kingdom, Ireland, Cyprus, Bulgaria, Croatia and Romania.
Who can apply for a residence permit?
Foreigners wishing to access the Golden Visa must meet one of the following conditions:
- To buy real estate in Spain for a value equal to or greater than 500,000 euros, using properties for residential or commercial use, whether the latter are premises or offices.
- Acquire one million euros in share capital as shares or participations in national companies.
- Bank deposits amounting to one million euros.
- Investments in Spanish public debt of two million euros.
- Investment in the constitution of companies oriented towards scientific and technological innovation that are of great economic interest to Spain and which involve the creation of jobs.
In addition to the investment requirement, it will be necessary:
- Be over 18 years of age.
- The Foreigner Identification Number (NIE).
- The certificate of ownership, charges and liens from the Land Registry.
- Proof that they have sufficient financial means to support the applicant and family members.
- To be the holder of a bank account in Spain to which an amount must be transferred for the applicant and another for each member of the family, in addition to 100% of the Public Indicator of Income with Multiple Effects (IPREM).
- They must not have entered Spain illegally or be in Spain illegally.
- To be the holder of a national medical insurance.
- Have no criminal record in Spain, in the country of origin or in the country of residence of the last five years.
- Not to be included as rejectable in the territorial space of countries with which Spain has signed an agreement to this effect.
- Residence permit application form.
- To pay the fee for processing the authorisation or visa.
Where do I apply for a Golden Visa?
The visa will be processed at the Spanish Consulate in the country of origin or residence. And the residence authorisation will be processed in the Large Strategic Collective Companies Unit.
What documents do I need to present in order to obtain a visa?
We have said in the article that one of the fundamental requirements for obtaining a residence visa for real estate investment is to prove, by means of the corresponding document, that the investment has been made.
The question now is: which documents exactly justify this investment? Let us look at it according to the path we have chosen to follow:
If we want to obtain the Golden Visa through the investment of real estate, we will have to provide as proof of the purchase of the property the certification of domains and charges of the Property Registry.
In the case of investing in Spanish shares or participations: a declaration of the investment from the Investment Registry of the Ministry of Economy in the case of participations; and a certificate from the financial intermediary registered with the National Securities Market Commission (Comisión de Nacional de Mercado de Valores) for the purchase of shares.
If what we have done is to invest in Spanish public debt, we will need a certificate from the Bank of Spain or the financial entity with which we have managed the investment in which we can clearly see how we are the holders of that purchase.
Finally, for investments in bank deposits, you will need the certificate issued by the financial institution with which you have contracted the deal, which states that you are the sole holder of that deposit.
How to prove your investment
It is necessary for the applicant to prove that he has made the investment in the minimum amount required, in a period not exceeding 60 days prior to the submission of the application.
If the purchase has been formalized
In order to be able to accredit the investment it is necessary to present the registry certification of domain and charges issued by the Registry of the Property, incorporating the same one an electronic code of verification for its online consultation and it must have been issued within 90 days previous to the request of the visa or if already in Spain, of the authorization of residence for investors or Golden Visa.
It is important to point out that the applicant for this residence permit is offered the opportunity to obtain financing to acquire the property, but only for the part of the purchase price that exceeds 500,000 €, as this amount must be credited both to apply for the investor visa or for the authorization of residence for investors or Golden Visa.
It should also be noted that if the investor’s visa is still being processed and the deed of sale is pending registration, a certificate can be presented where the presentation entry is valid and the payment of the corresponding taxes is accredited.
If the purchase has not been formalised
If the foreign investor has not formalised the purchase of the property or properties, but there is a pre-contract with a guarantee in its fulfilment by means of a deposit or other means admitted in law formalised in a public deed, the pre-contract with a guarantee together with a certificate from a financial institution established in Spain in which it is verified that the applicant has a bank deposit available with the necessary amount for the acquisition, fulfilling the committed contract, of the property or properties indicated, including charges and taxes.
The amount of the deposit may only be used for the final purchase of the property or properties indicated in the pre-contract with guarantee. In this case, the interested party will receive a residence visa for investors with a maximum duration of 6 months, instead of the usual duration of one year. If the actual purchase of the indicated property or properties is proven, the interested party may apply for a residence permit for investors.
